- Have a clean criminal record on bulletin n°2 (no criminal conviction)
- Not having undergone a prohibition of carrying on a commercial activity

Define the nature of your business: liberal or commercial?
If you are the manager and only instructor of the driving school, your activity is considered liberal.
If you have at least one salaried instructor, your activity is commercial.
In any case, you must register your company on the website of the Window of company formalities.
Choose the legal form of your company
You have to choose the status of your company.
You have the choice between 2 statuses:

Weaknesses
Administrative procedures in the form of business are longer.
You must write and save your business' statutes.
If you have a partner, you have to make the decisions together.
Declare your activity, register your company

The registrant must digitize and then upload the supporting documents following:

Local dedicated to your company
You must be the owner or tenant of a space dedicated to your activity.

The room must measure 25m2 minimum.
The premises must include 2 rooms separate, one of which must be phonetically isolated for teaching.
Control of the prefecture
The prefecture carries out a control to verify that your premises are compliant.
Depending on your status, you must provide the prefecture during the check, one of the following documents:
- Title of ownership
- Commercial Lease Agreement
- Professional Lease Agreement
Owner (liberal or merchant)
You must provide the deed of ownership space dedicated to your driving school.
Liberal tenant
You must provide the professional lease agreement of your premises.
Tenant trader
You must provide the commercial lease agreement of your premises.
Vehicles dedicated to teaching
You must own or rent the vehicle(s) dedicated to driving training.
You must provide the certificate of registration ({circumflex over (a)}) for each vehicle or the lease agreement.
Vehicles must be insured.
You must provide the certificate of insurance covering damage that may result from accidents caused to other people. This is a professional insurance to be taken out with your usual insurer.
Please note
Provided that they belong to candidates registered at the driving school, you are not obliged to provide proof of ownership or rental for motorcycles or 3-wheel scooters with a power of less than 15 kw. This also applies to light and heavy motor quadricycles and vehicles used by persons with disabilities.
Apply
To be entitled to teach driving, each instructor must have a permission to teach.
This is a card issued by the prefecture of department.
It's free. It must be renewed every 5 years.
You have to download the application form on the website of your prefecture.
You have to fill out the form and collect the documents to be provided.
You address all of it by post to your prefecture.
In some departments, the process can also be done entirely on the site "démarches-simplifiées.fr".
Conditions for obtaining it
You must complete all conditions following:
- Be old of 20 years minimum
- Have the license B for 3 years minimum and hold the other licenses for which you are training in your driving school (A license, B1 and BE license, C license, etc.)
- Have obtained the BEPECASER: titleContent or an equivalent recognized diploma or certificate
- Have spent a medical check having given rise to a positive medical opinion approving that you can practice this profession (cerfa no. 14880). Only a licensed doctor can do this check. - Have a clean criminal record on bulletin n°2 (no conviction criminal)
Documents to be provided
- 2 identical identity photos with your name and surname on the back
- Photocopy of a valid identity document (double-sided national identity card or passport)
- Photocopy of proof of residence less than 3 months old
- Duplex/reverse copy of driver's license
- Photocopy of the medical certificate of less than 2 years attesting that you are fit to teach driving established by one of the doctors approved by the prefecture
- Photocopy of BEPECASER: titleContent
Please note
Depending on the department in which you reside, you must also provide 1 postage-paid envelope at the current registered rate with acknowledgement of receipt, with your name and address written on it.
Apply to the prefecture
You must apply for approval at the prefecture of your department.
Accreditation is proof that you meet all the necessary conditions to manage a driving school.
You must apply for registration for each establishment if you manage several.
Approval is valid 5 years, renewable.
The request is free of charge. It is done very often online only or on the website of the prefecture of your department, or on the website "simplified procedures.fr".

Business

You must display the approval order visibly in your premises. The approval number must appear on your commercial or advertising documents.
Recruit, hire
Recruiting an instructor is a perspective for the development of your business.

Every instructor in your driving school must have the teaching authorization card valid.
General obligations for each vehicle
- Pass a roadworthiness test mandatory (on 1er must take place 4 years after the first release, the following every 2 years)

Equipment obligations per vehicle
Each vehicle shall include the equipment following:
- Steering wheel located at the driver's station, on the left front of the vehicle
- Dual brake and clutch control (except for automatic shifting vehicles)
- Dual acceleration control, (decommissioning during driving test)
- 2 interior mirrors adjusted for the student and the monitor (except for goods or passenger vehicles)
- 4 external side mirrors, left and right, set to be used by the student and the monitor (for vehicles under 3.5 tons, the left external mirror is not intended for the monitor)
- Dual control of horn, lights (position, passing, route) and direction change indicator within immediate range of the monitor
- For 2 or 3-wheelers: approved device allowing a permanent (radio) connection between the monitor and each student, when the monitor is not on board the vehicle
- Signs or inscriptions visible from the front and from the rear, with one of the following particulars: driving school, driving school, motorcycle school, driving school or motorcycle school (without any other indication, in particular advertising), placed either at the front and at the rear or on the roof (minimum dimensions: 40 x 12 cm, maximum 50 x 15 cm for a private car, dimensions: 100 x 30 cm for heavy goods vehicles, where they must be placed at the front and at the rear of vehicles)
- For 2 or 3-wheelers, mention motorcycle school or cycle school shall be clearly visible from the front and from the rear, either on two signs or inscriptions placed on the vehicle or on a fluorescent vest worn by the student driver and by the monitor when seated at the rear of the vehicle.

Renew your 2 cards: accreditation and authorization to teach
Each of these cards is valid 5 years.
