BTP card: professional identification card of a BTP employee

On a building or public works site, the performance of certain works requires the employee to hold a professional identification card: the BTP card. The employer is responsible for the declaration allowing the issuance of this card. We take a look at the regulations, which differ depending on whether the company is a work company temporary or not or depending on whether a foreign company detach an employee in France.
What applies to you ?
General case
It is an individual and secure card that reliably identifies any employee who works on a site.
It makes it possible to better combat illegal work and unfair social competition. It is often referred to as a “card” BTP: titleContent ».
Employees holding the BTP card must present it without delay to the control agents of the State services, at the developer or at ordering party intervener on the site.
The employer must declare the employees who carry out, direct or organize, on a site or site, building or public works. These works include earthworks, construction, demolition.
It is not the sector of activity of the company that is taken into account, but the nature of the work performed by the employee.
The employer is exempt from declaring and applying for a card BTP: titleContent for the following employees:
- Employees on construction sites working as architects, real estate diagnosers, surveyors, safety and health protection coordinators, drivers, delivery drivers, surveyors and surveyors
- Employees whose positions do not involve any mission on a site even if they are permanently present (payroll management, risk management, IT maintenance, for example).
Trainees are not concerned, provided that the tutor can present proof of status.
The card must be requested upon hiring by the employer or his agent. The employer is responsible for the declaration of the employee allowing the issuance of the card.
The card order BTP: titleContent is performed exclusively by internet.
The employer must create an account on the following website:
The employer pays for each card a flat fee of €9.80.
The dematerialized payment can be made only:
- By credit card
- By cash advance
- By bank transfer.
The map BTP: titleContent is valid for the entire duration of the contract, whether it is a FIXED-TERM CONTRACT: titleContent or a DTA: titleContent.
When the contract is terminated or broken, the card is returned to the employer.
The professional identification card may be replaced by a provisional certificate. This certificate is issued at the end of the application process and payment of the card BTP: titleContent.
This provisional certificate allows the employee to justify his situation pending receipt of the final BTP card.
If a card is damaged, the employer must return it to the address on the back of each card. It will be invalidated and destroyed.
If a card is lost or stolen, the employer must inform the body in charge of managing the device.
Whether the card is lost, stolen or damaged, the employer must order and pay for a new card for the employee concerned.
If the employer fails to comply with its reporting obligation, it risks €4,000 fine per employee.
In case of recidivism within 2 years, the fine can go up to €8,000.
