Local advertising regulation (RLP)

The local advertising regulations (RLP) allows local adaptation of certain points of the national regulations applicable to advertisements, signs and pre-signs.
What is it?
The local advertising regulation is intended to regulate the location and use of signs, pre-signs and outdoor advertisements located in the territory of a EPCI: titleContent or a municipality.
The Local Advertising Regulation (RLP) is drawn up by the EPCI: titleContent competent in matters of MORE: titleContent, the metropolis of Lyon or, failing that, the municipalities.
The EPCI: titleContent with competence RLP: titleContent are also competent, even if they are not in the field of PLU.
When it is developed at the inter-municipal level by an EPCI, it covers the entire territory of the latter. In this case, we speak of local regulation of intercommunal advertising (RLPi) and it is approved by deliberation of the community council.
We are talking about communal RLP when it is drawn up by the municipality. It covers the entire territory of the municipality and is approved by deliberation of the city council.

What's the point?
Local advertising regulations adjusts national regulations in relation to local issues (e.g. reconciling economic dynamism and quality of life).
Thus, the Regulation may apply, in the areas it defines, a more restrictive regulation the requirements of national legislation, for example:
- Limit the number and format of wall-mounted advertising devices
- Ban ground-sealed ads
- Prohibit wall advertisements in classified woodlands and natural areas to be protected listed in the local urban planning plan (PLUS). Under national legislation, only ground-sealed devices are prohibited in these spaces
- Limit the advertising of light and light signs, including determining different extinction ranges according to zones or according to the time of year
- Frame bright advertisements and bright signs located inside the windows or bays of a business. The RLP may lay down requirements concerning the time of extinguishing, the surface area, energy consumption and the prevention of light pollution
- Limit advertising devices, whether bright or not, installed on theright-of-way sports facilities with a seating capacity of at least 15 000 and located in urban areas.
The local advertising regulation may also provide for more flexible regulation, for example:
- Derogate from the ban on advertisements near historical monuments, within the scope of remarkable heritage sites, in regional nature parks, in registered sites, within 100 meters and within the field of visibility of buildings of an aesthetic, historic or picturesque character, in thearea of accession national parks and in the special areas of conservation and special protection areas.
- Derogate from the ban on out-of-town advertising by allowing it in the immediate vicinity of shopping centers exclusive of any dwelling.

Derogation from the ban on out-of-town advertising by allowing it in the immediate vicinity of the exclusive shopping centers of any dwelling.
The Local Advertising Policy (RLP) includes the following items :
- Presentation Report : it is based on a diagnosis to define the orientations and objectives of the municipality or theEPCI: titleContent in the field of external advertising, in particular density and harmonization. The report explains the choices made in the light of these guidelines and objectives.
- Regulatory part : it adapts national regulations to local configurations (e.g. places where advertising is permitted or prohibited). It may provide for more restrictive rules, in particular on luminous advertising and luminous signs.
- Annexes : they include, in particular, the graphic documents defining the perimeter of the agglomeration and the areas concerned by the regulation.
This Regulation is annexed to local urban planning plan (PLUS) of the commune, if it exists.

The graphic documents annexed to the local advertising regulations (RLP) must identify, throughout the territory of the municipality or intermunicipality, the zones or perimeters concerned by the Regulation.
The Regulation should also set out the limits of the agglomeration set by the mayor.
FYI
When a new local advertising regulation comes into force, all existing devices (advertisements, signs, pre-signs) must be brought into compliance in a 2-year delay from that entry into force.

When adopted, the local advertising by-law shall be annexed to the local urban planning plan (PLU) and be displayed for 1 month at the town hall, at the headquarters of theEPCI: titleContent competent or from the metropolis of Lyon.
Thereafter, the regulation must be made available to the public on the website of the municipality (where this site exists) or in town hall.
