Influencers: new mandatory information in case of promotion of professional training

A decree of 30 March 2026 sets out the information that influencers must mention when promoting publicly funded training (such as the CPF for example). These new provisions apply from 2 April 2026.

In order to regulate commercial influence and combat deceptive commercial practices, the “Influencers” law of 9 June 2023 set out a legal framework. In particular, it states that the promotion of publicly funded training must include several pieces of information. The latter are indicated in the decree of 30 march 2026.

Content promoting this type of training must now contain:

  • an indication of the public nature of the financing of vocational training, the existence of commitments and eligibility rules;
  • depending on the medium, a hypertext link to the applicable regulations, a mention of the website containing this information or an information message.

These elements must be presented ‘ legibly or audibly, depending on the medium, distinguishable from the promotional message and from any other mandatory statement’.

In the case of a video (or still image), mandatory notices must be broadcast for at least 90 % of the duration of the promotional material. A space on the screen must be reserved for this purpose. This space must be horizontal and occupy 7% of the advertising space.

If the promotion is broadcast or offered as on-demand audio, these elements must be pronounced immediately after the promotional message.

A person who fails to comply with these obligations shall be liable to a term of imprisonment of one year and €4,500 of a fine.
