Seniority criterion and CSE: extension of the compliance deadline

Following a ruling by the Court of Cassation, the Urssaf now prohibits access to the services of the Economic Social Committee (CSE) from being subject to a condition of seniority. The deadline for ESCs to comply has just been extended by one year. They therefore have until 31 December 2026 to comply with that case-law.

In a judgment of 3 april 2024, the Court of Cassation ruled that an ESC cannot make the benefit of social and cultural activities conditional on a period of seniority.

In fact, new employees were required to serve six months in order to benefit from these activities. According to the Court, this constituted discrimination.

The Urssaf states that the CSEs now have until 31 December 2026 (instead of 31 December 2025) to comply with that case-law.

An adjustment of contributions may be made by the Urssaf in the event of non-compliance.

The social and cultural activities of the EESC are exempt from social contributions.
