  3. Print in 2 copies
  4. Date and sign each copy
  5. Prepare a slip of supporting documents
  6. Send or Drop the 2 copies of the form, the slip and the documents before the competent court :
    • General scenario: judicial tribunal of the debtor's domicile (or one of the debtors)
    • Debt of co-ownership charges: court of justice of location of the building

  • Documents supporting your claim: all documents proving the existence of the claim, its amount and the absence of payment
  • Voucher: list of your supporting documents

You must await notification of the decision which is sent to you at the address provided.

If your application is rejected, you can bring the matter before the court under ordinary procedure.

Please note

If you do not get the full amount of money claimed, you can use the regular procedure to get a larger conviction. In this case, the order for payment must be waived (not served on the debtor).

You have to do signify an order for payment to the debtor(s).

Service must take place within the period of 6 monthsotherwise, the order is no longer valid. The starting point for this period is the date of the order.

Warning  

After service of the order, you no longer have any recourse to obtain a more significant conviction from your debtor.
