Social consequences of the cessation of activity for an individual entrepreneur

Verified 09 October 2026 - Entreprendre Service Public / (Prime Minister)

In the event of cessation of activity (reorganization or judicial liquidation, voluntary cessation of activity), an individual entrepreneur enjoys certain social rights: maintenance of his health coverage, payment of a self-employed worker's allowance (ATI) if he meets the conditions, and possibly opening his pension rights.

The cessation of activity leads to the regularization of social contributions, i.e. the adjustment between the provisional contributions already paid by the individual entrepreneur and the final contributions calculated on the basis of his real income. However, even if it is removed from theUrssaf: titleContent the entrepreneur continues to benefit from health coverage.

Removal from the Urssaf

To declare the cessation of activity, the individual contractor must complete a full cessation of activity form on the site of the company formalities desk:

Window of company formalities

Upon registration of the cessation of activity, the Urssaf shall send the individual contractor the following documents:

  • Notification of cancelation
  • Tax return form to be completed and sent from the Urssaf messaging. The individual entrepreneur then has 90 days to declare his final professional income. This statement is used to account accrual with the Urssaf, including in the event of retirement.

FYI

In the event of judicial liquidation, the liquidator or the agent shall transmit to the Urssaf the judgment ordering the closure of the proceedings. The individual contractor then receives a notification of cancelation within 30 days of the judgment. If this is not the case, the individual contractor must transmit this judgment directly to the Urssaf.

The Urssaf provides the individual entrepreneur with a simulator that allows him to estimate the amount of contributions that are due before he ceases his activity:

Maintenance of health coverage and care

When the individual entrepreneur ceases his activity, his health coverage is covered by the French primary health insurance fund (Cpam) of his place of residence.

Who shall I contact

The entrepreneur can find out about the care of his health (access to rights and care in particular) from the coordinated help of the social security: Help!.

To learn more, you can visit the Urssaf page:

The individual entrepreneur (craftsman, merchant or liberal professional) who has ceased his activity involuntarily and permanently cannot perceive thereturn-to-work assistance allowance (ARE). On the other hand, he can benefit from theself-employed worker allowance (ATI) if it fulfills certain conditions.

The ITA is paid by France Travail.

FYI

The individual entrepreneur is entitled to specific unemployment insurance when he has voluntarily contributed to a private body (such as the Association for the Protection of Independent Employers (APPI) or the Association for the Social Guarantee of Heads of company (GSC)). This optional unemployment insurance may be paid in addition to or instead of the ITA.

Condition of cessation of activity of the individual business

A mere cessation of activity does not allow to benefit from the ITA.

The activity must have ceased:

The non-viability of the activity results from a decrease of at least 30% income declared by the self-employed person when declaring income tax, attested by a trusted third party (either an accountant or a representative of the Chamber of Commerce and Industry (CCI), Agriculture or Trades and Crafts (CMA)).

Conditions for the award of the ITA

To qualify for the self-employed worker allowance (IWA), the individual entrepreneur must complete all of the following conditions :

  • Proof of self-employment for a minimum period of 2 years without interruption
  • Be actually looking for a job and registered as a job seeker
  • Prove, in respect of self-employed activity, previous income from activity equal to or greater than €10,000  per year over one of the 2 calendar years of activity preceding the year of cessation
  • Justify resources below a monthly ceiling equal to the amount of the RSA: titleContent for a single person, either €651.69.

Entitlement to the return-to-work (ARE) allowance is also examined if the entrepreneur fulfills the conditions. In this case, this fee is paid in place of the ITA if it is more advantageous.

Approaches and duration of the ITA

The individual contractor must register on the France Travail website within 12 months of the cessation of company. Once registered, he receives a file that he must complete and return to France Travail accompanied by the requested documents.

When the contractor fulfills the conditions, the ITA is allocated to him for a period of 182 calendar days (about 6 months). This period shall run from the date of entry on the list of jobseekers.

To learn more about the ATI application and its amount, consult the dedicated sheet on the France Travail website:

The individual entrepreneur who ceases his activity and is approaching retirement can inquire with his pension organization to know his rights. If the contractor is of retirement age, he/she must file his/her application 4 to 6 months before the retirement date with the pension insurance.

For more information, you can consult the dedicated page on the pension insurance website:

FYI

Where the individual contractor exercises a regulated liberal activity, he must apply to the pension fund on which he depends. For more information, refer to the fact sheet on the social protection for the liberal professional.

When the individual entrepreneur is close to retirement and encounters financial difficulties, he can benefit from a retirement support scheme (ADR).
