Elections in companies with less than 11 employees

In companies with fewer than 11 employees, there is no Social and Economic Committee (ESC). In these companies, elections VSE are organized every 4 years at the regional level to measure the union audience. These elections also concern employees of the individual employer, including childminders. These employees are called to vote for trade unions. We're taking a look at the regulations.

The results of the TPE elections are added to those of the CSE: titleContent. They allow to measure the representativeness of trade union organizations.

Representativeness is calculated at the professional branches on the plan national and interprofessional.

This hearing measure is used to designation of salaried labor court advisors.

It is also used for distribution of seats enter trade union organizations within the Inter-professional Regional Joint Commissions (IRPCs). This committee informs and advises employees and their employers.

To be voter to the professional elections of VSEs (company employing less than 11 employees on 31 December of the year preceding the election) the 3 following conditions :

  • Have a employment contract during the month of december of the year preceding the election
  • Be old of At least 16 years old on the date of the opening of the ballot
  • Not to be the subject of a prohibition, forfeiture or incapacity concerning its civil rights.

Warning  

Employees in the agricultural sector are not concerned. They fall under a specific scheme.

The employee is entered on the electoral list of the region in which the company or establishment is located and in which he carries out his main activity.

The employee is registered on the electoral roll under the branch to which he reports.

The voters list is compiled by the Ministry of Labor. It is based on the data transmitted by the social security funds (registered social declaration for the general scheme and specific funds for the other schemes).

Voting is organized at regional level every 4 years.

The vote shall be taken by electronic means or by correspondence.

The list of applications trade union organizations are approved by the Ministry of Labor.

The employee receives an identification document by post at home.

This document shall contain the following information:

  • First and last names and domicile of the elector
  • College (executive or non-executive) and branch to which it depends
  • Registration Region and Department
  • The serial number assigned to it on the list of slots
  • Voting periods
  • Information required for postal voting (return envelope and list of candidates)
  • Elements enabling the voter to vote electronically remotely (website address and login credentials).

Employees who have exercised their right to vote electronically can no longer vote by post.

Electronic voting

The employee connects to the website on his identification document.

The employee chooses to vote for a representative union organization or for a union affiliated with a representative union organization.

The employee thus votes directly for a union. He doesn't vote for a candidate or a list of candidates.

The employer must give the employee time to vote, in the workplace, in complete confidentiality. When voting takes place during working hours, this time shall be considered as working time and shall be paid at the normal time.

Once the vote has been taken, the employee receives an electronic acknowledgement of receipt attesting to his or her vote.

The anonymity of the vote is guaranteed.

FYI  

The employer is not obliged to make available to the employee the computer equipment enabling electronic voting. In this situation, the employee can vote by mail.

Vote by post

The employee signs his ballot. He uses the return envelope to send his ballot to the processing center.

The anonymity of the vote is guaranteed.

The employee chooses to vote for a representative union organization or for a union affiliated with a representative union organization.

The employee thus votes directly for a union. He do not vote for a candidate or a list of candidates

The next elections will be held in 2028.
