Some holidays are public holidays that can be unemployed persons or worked and paid on terms and conditions that vary from case to case (1er May or other). In some cases, public holidays allow you to benefit from a bridge. The arrangements for the day of solidarity shall be laid down by agreement or company or establishment agreement or, if not, by branch agreement. We present you the information to know.

General case
Among the legal holidays, only the 1er may is obligatory unemployed for all employees (all companies and categories combined).
By exception, the employee can work on 1er but when employed in a company which, due to the nature of the activity, cannot interrupt work (e.g. hospitals, public transport).
Other public holidays shall be non-working days if provision is made for them:
- By the collective agreement or by a branch agreement or a company or establishment agreement
- Or, in the absence of an agreement or agreement, by the employer.
The employee is not obliged to recover the hours of work not worked on an unworked holiday.
A public holiday may fall on a day that is usually not worked (for example, Sunday).
In this case, the employee cannot claim any additional day off.
However, treaty provisions may provide for more favorable conditions.
Under 18
An employee or apprentice under the age of 18 cannot work on statutory holidays.
However, exceptions are possible in the following sectors:
- Hospitality, catering, catering or reception organizer
- Coffee, tobacco or beverage outlet
- Bakery, pastry shop, butcher, cold cuts, cheese-cream shop, fish shop
- Company of other sectors mainly producing food products for immediate consumption or whose exclusive activity is the retail sale of food
- Flower shop, garden and grain shop
- Shows.
An employee or apprentice under the age of 18 who works on a public holiday shall be entitled to a weekly rest period of at least 36 consecutive hours.
General case
Unemployment on public holidays may not result in any loss of salary for the employee with at least 3 months of service in the company.
Seasonal employees who have signed various employment contracts in the company (successive or not) are also fully paid if their total cumulative seniority is at least 3 months.
The payment of public holidays is not due for the following employees:
- Employee working from home
- Intermittent employee
- Temporary employee (the holiday must however be paid to the temporary employee as long as this holiday is included in his mission).
However, treaty provisions or uses in the company may provide for more favorable conditions.
May 1
On 1er May is a public holiday and a non-working day.
The public holiday of 1er but can not be a cause of salary reduction.
Employees paid by hour, day or output are entitled to compensation equal to the salary lost as a result of this unemployment. This allowance is payable by the employer.
The employee who works on 1er mai benefits from the doubling of his remuneration.
A bridge day preceding or following a public holiday may be provided for in the company.
There is no regulation of this practice.
The allocation of a bridge may be provided for by treaty provisions, a collective agreement or be decided by the employer.
Hours not worked due to the bridge may be worked at another time to compensate.
These hours can be recovered within 12 months before or after the bridge. These hours are not subject to any salary increase.
For example, hours lost on the bridge can be recovered when:
- 1 or 2 working days are unemployed between a public holiday and a weekly rest day,
- 1 day prior to annual leave is unemployed.
The day of solidarity consists of an extra day of work. It is intended to finance actions to promote the autonomy of the elderly or disabled.
The solidarity day takes the form of an additional day of work per year without pay.
It may provide for:
- Either work on a previously non-working holiday other than 1er May (Whit Monday, for example)
- Either the work of a day of RTT provided for in the framework of a working time organization agreement
- Or any other mode of organization allowing the work of 7 hours previously not worked (work on a Saturday, for example).
The conditions for the completion of this day are set:
- Either the collective agreement or by a branch agreement or a company or establishment agreement
- Either, in the absence of an agreement or agreement, by the employer after consultation with the Social and Economic Committee (ESC).
The hours worked during the solidarity day shall not be remunerated:
- That is to say a maximum of 7 hours unpaid for monthly employees, reduced in proportion to the contractual duration in the case of part-time work,
- Either a maximum of one working day for the employee who works on the days package.
Hours worked during the solidarity day are not considered overtime.
Please note
In Alsace-Moselle, the day of solidarity cannot be completed on December 25 and 26, nor on Good Friday.
Due to a change of employer, an employee may have already completed an additional day of work during the current year as part of the solidarity day.
In this case, if he is required to perform a new day of solidarity, the hours worked are remunerated and considered as overtime. These hours give rise to a compulsory counterpart in the form of rest.
The employee may refuse to perform this additional day of work without such refusal constituting a fault or a ground for dismissal.
