What are the thresholds for advertising public contracts?
Verified 01 April 2026 - Entreprendre Public Service / Directorate of Legal and Administrative Information (Prime Minister)
The public purchaser shall publish a contract notice for supply or service contracts of an amount equal to or greater than €60,000 HT. This threshold is raised to €100,000 HT for works contracts.
Lcontract notice summarizes all items concerning the buyer's need: the nature of the assignment, the criteria for selecting the successful candidate, the location of the assignment, the deadline for submitting the application, deadlines, etc. It allows a company to assess whether it has the capacity to carry out the assignment in question.
The contract notice concerns adapted procedure contracts (MAPA) and the formalized procedure contracts. It is published on one or more advertising media.
FYI
The contract notice is not mandatory for supply and service contracts of an amount less than €60,000 and for works contracts of less than €100,000. For more information, you can consult the fact sheet on different public procurement procedures.
The contract notice shall be published on different media depending on the procedure. These are the following media:
- Buyer Profile : it is an electronic “marketplace”. Each public purchaser must have a buyer profile that allows them to publish their contract notices and company consultation files (DCEs), to receive applications and electronic offers in a secure and confidential manner, to manage questions/answers with candidates
- Official Bulletin of Public Procurement Announcements (BOAMP) : it concerns the contract notices of adapted procedures (MAPA) and formalized procedures.
- Support entitled to receive legal notices (Shal) : for adapted procedure contracts (MAPA)
- Official Journal of the European Union (OJ) : for legal announcements of formalized procedure contracts
The works contracts concern the construction of structures, building works and civil engineering (bridges, roads, ports, dams, urban infrastructure, etc.).
The type of advertising depends on the value estimated market and market type of public purchaser who makes the contract:
- If the estimated value of the contract is €100,000 and €5,404,000, the public purchaser is obliged to publish either at BOAMP: titleContent or in a Shal: titleContent.
- Beyond €5,404,000, the buyer must comply with a formalized procedure.
The amounts of the works contracts determine the applicable advertising.
Amount excluding tax | Type of advertising |
|---|---|
From €100,000 à €5,403,999.99 | Mandatory publication of the contract notice in BOAMP: titleContent or in a Shal: titleContent |
From €5,404,000 | Mandatory publicity of the contract notice to the BOAMP and at CHEEK: titleContent for a formalized procedure |
FYI
The public purchaser has the possibility to award works contracts below €100,000 HT without advertising or competition.
