What are the thresholds for advertising public contracts?

The public purchaser shall publish a contract notice for supply or service contracts of an amount equal to or greater than €60,000 HT. This threshold is raised to €100,000 HT for works markets.

Lcontract notice summarizes all items concerning the buyer's need: the nature of the assignment, the criteria for choosing the successful candidate, the location of the assignment, the deadline for submitting the application, deadlines, etc. It allows a company to assess whether it has the capacity to perform the assignment in question.

The contract notice concerns adapted procedure contracts (MAPA) and the formal procedure contracts. It is published on one or more advertising media.

The contract notice is not mandatory for supply and service contracts of an amount less than €60,000 and for contracts for works under €100,000. For more information, you can consult the fact sheet on different public procurement procedures.

The contract notice shall be published in different formats depending on the procedure. These are the following:

Works contracts concern the construction of works, works and civil engineering (bridges, roads, ports, dams, urban infrastructure, etc.).

The type of advertising depends on the value estimated market and type of public purchaser who passes the contract:

  • If the estimated value of the contract is €100,000 and €5,404,000, the public purchaser is obliged to publish either at BOAMP: titleContent or in a Shal: titleContent.
  • Beyond €5,404,000, the buyer must comply with a formalized procedure.

The amounts of the works contracts determine the applicable advertising.

The public purchaser has the possibility to award contracts for works below €100,000 HT without advertising or competition.

Warning  

Until 31 December 2026 included, public purchasers may conclude a contract for works relating to installation of heat pumps in buildings or in connection with the district heating network in the following cases:

  • the contract is worth less than €140,000 HT
  • lots are less than €140,000 HT, and the aggregate amount of such lots shall not exceed 20 % of the total estimated value of all lots.

From 1er January 2027, public purchasers will be able to award works contracts without advertising or competition up to €140,000 HT.

The supply contract consists of the purchase or leasing, rental or hire-purchase of equipment, furniture or products (office supplies, paper, furniture, vehicles, etc.).

The type of advertising depends on the value estimated market and type of public purchaser who passes the deal.

  • The buyer may resort to a adapted procedure (MAPA) of which it shall freely determine the conditions if the estimated value of the contract is less than one of the following amounts:
    • €140,000 for a central authority
    • €216,000 for another contracting authority
    • €432,000 for a procuring entity.
  • Beyond these thresholds, the public purchaser must comply with a formalized procedure.

A service contract concerns a material service (for example, the maintenance of premises or green spaces) or an intangible service (legal advice, accounting expertise, IT project, etc.).

The type of advertising depends on the value market estimate and of the type of public purchaser who passes the market.

The buyer may resort to a adapted procedure (MAPA) of which it shall freely determine the conditions if the estimated value of the contract is less than one of the following amounts:

  • €140,000 for a central authority
  • €216,000 for another contracting authority
  • €432,000 for a procuring entity.

Beyond these thresholds, the public purchaser must comply with a formalized procedure.
