Private sector: what is the employment obligation for disabled workers (OETH)?

The Employment Obligation for Disabled Workers (OETH) imposes on any employer with cash at least 20 employees to employ workers with disabilities up to 6 of total employees. This scheme aims to promote the integration of disabled workers into employment. We tell you what you need to know.
Persons concerned by the employment obligation of disabled workers (OETH) called beneficiaries of the employment obligation for disabled workers (BOETH) are those in one of the following situations :
- To be recognized disabled worker (RQTH) by the Commission on the Rights for the Autonomy of Persons with Disabilities (CDAPH)
- Have the mobility inclusion card (CMI) disability mention
- Perceive the Disabled Adult Allowance (DAA)
- Have been the victim of an occupational disease or illness that has resulted in a permanent disability of at least 10% and receive an annuity
- Perceive a invalidity pension provided that the invalidity reduces his working or earning capacity by at least 2/3
- Have occupied a reserved employment (military, ...) and receive an invalidity pension
- Have been volunteer firefighter and receive an invalidity allowance or annuity awarded because of an accident or illness in service.
FYI
One attestation shall be issued at the same time as the notification the decision placing those persons in one of those situations. It specifies that the person is BOETH and allows to assert his rights with the employers and organizations concerned. For persons recognized as RQTH, the notification of the departmental house of disabled persons (MDPH) serves as a certificate.
BOETH's status results from a administrative decision (RQTH, AAH, disability MIF, disability pension, etc.).
There's no no steps to take with an employer to obtain this status.
Where a person has evidence of entitlement to the EAPO, he or she may choose to forward it to his or her employer. With this agreement, the employer declares BOETH status to theUrssaf: titleContent. This declaration allows:
- account for the person in the employer's employment obligation
- mobilizing disability-related support or accommodation, if necessary.
Anyone who thinks they are affected can request an RQTH with the MDPH. The RQTH allows to obtain the status of BOETH and to access accompanying measures in employment.
Recognition as a BOETH entitles to several measures, including:
- easier access to employment (priority hiring in certain sectors, financial aid for the employer, adjusted contracts or specific measures such as Adapted companies or establishments and services supporting work-Ésat)
- the layout of the workstation (equipment, flexible working hours, accessibility, etc.)
- personalized support (individualized follow-up, adapted training, ...)
- enhanced protection against any form of discrimination linked to disability (hiring, dismissal, etc.).
