New modalities for pre-recovery and recovery visits

The decree on pre-resumption and return visits after a work stoppage was published on 14 June. Undertake Public Service explains.

In which cases should the pre-mission visit take place?

The pre-business visit allows you to anticipate and accompany an employee during a stop. However, it is not mandatory.

It may be requested by:

  • the occupational physician;
  • the attending physician;
  • the medical officer of the social security institutions;
  • the employee himself.

At the end of this visit, the doctor may request adaptations or adjustments, recommendations for reclassification or the establishment of vocational training.

In which cases should the return visit take place?

The return visit is a medical examination to assess the employee's health. It must be carried out by the occupational physician on the same day as the return to work or within 8 days. It is up to the employer to ask the prevention and occupational health department for the date of the return visit.

It must take place in the following cases:

  • after maternity leave;
  • after an absence of at least 30 days due to accident at work;
  • after an absence of at least 60 days due to illness or occupational accident;
  • as a result of an absence due to occupational disease.

The doctor may recommend adjustments to the position, check whether the professional activity is compatible with the employee's state of health or issue a notice of incapacity.

Any employee who has been on sick leave for more than 30 days is entitled to request a pre-work visit.

What are the new arrangements for pre-recovery and recovery visits?

The decree on the modalities of pre-take and take-over visits brings several evolutions.

Thus, the employer must now be informed by the prevention and occupational health service (SPST) of the organization of a pre-start visit even in the absence of a recommendation from the occupational physician. However, the worker may object if he wishes.

In addition, unless requested by the occupational physician, the employer or the worker, the return visit is not required if the following two conditions are met:

  • the worker has already had a pre-work visit within 30 days before resuming work;
  • during the pre-start visit, the occupational physician states that « no individual measures for the organization, adaptation or transformation of the position or any measures for the organization of working time were necessary for the resumption ».

Nevertheless, even if the conditions for exemption are met, the employer, the occupational physician or the employee retain the right to request a return visit.

These new provisions concern work stoppages issued from 15 June 2026.
